1. Acceptance of Terms

Welcome to ROCA WORLD FITNESS. By downloading, accessing, or using our mobile application and website (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service. You must be at least 18 years old to use the Service.

2. Description of Service

ROCA WORLD FITNESS provides a fitness coaching platform that includes personalized training programs, nutrition plans, progress tracking, AI-powered coaching recommendations, an athlete community network, challenges and competitions, an online store for fitness products, and booking for one-on-one coaching sessions. The Service is offered as a subscription-based platform with both digital memberships and physical product sales.

3. Account Registration

To access most features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account
• Not share your account credentials with others

You may register using your email address or through Google sign-in. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Billing

4.1 Digital Subscriptions

We offer Basic ($80/month) and Premium ($149/month) coaching memberships, as well as 6-month and 12-month prepaid plans. Subscriptions purchased within the mobile app are billed through the Apple App Store or Google Play Store and are subject to their respective terms of service.

4.2 Physical Products and Coaching Sessions

Purchases of physical products from our store and bookings for one-on-one coaching sessions are processed through Stripe. Prices are displayed in US Dollars (USD) and include applicable taxes and shipping at checkout.

4.3 Auto-Renewal

Digital subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your Apple ID or Google Play account settings. Refunds for digital subscriptions are governed by the respective app store's refund policy.

5. User-Generated Content

You may create and share content in the community, including posts, photos, videos, comments, and messages. You retain ownership of your content but grant ROCA WORLD FITNESS a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the Service.

You agree not to post content that:

• Is defamatory, hateful, discriminatory, or harassing
• Infringes on intellectual property rights of others
• Contains sexually explicit or violent material
• Promotes illegal activities or dangerous behavior
• Contains personal or private information of others without consent
• Is spam, misleading, or fraudulent

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of repeat violators.

6. Health and Fitness Disclaimer

The Service provides fitness coaching, nutrition guidance, and AI-generated recommendations for informational and educational purposes only. We are not licensed medical professionals. Always consult with a qualified healthcare provider before beginning any exercise program, nutrition plan, or making changes to your health regimen. Do not disregard professional medical advice or delay seeking it because of something you read in the Service. If you experience pain, dizziness, or discomfort during exercise, stop immediately and seek medical attention.

7. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or another user's account
• Interfere with or disrupt the Service or servers
• Use bots, scrapers, or automated tools to access the Service
• Impersonate another person or misrepresent your affiliation
• Engage in any conduct that could damage or harm other users
• Reverse engineer, decompile, or disassemble any part of the Service

8. Intellectual Property

All content, features, and functionality of the Service — including training programs, nutrition plans, videos, graphics, logos, and software — are owned by ROCA WORLD FITNESS and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Affiliate and Ambassador Program

The Service includes an affiliate/ambassador program that allows users to earn commissions on referred sales. Participants must comply with program guidelines. Commission rates, payout thresholds, and terms are displayed within the app and may be updated at our discretion. We reserve the right to modify or terminate the affiliate program at any time.

10. Disclaimers and Limitations of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, ROCA WORLD FITNESS shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Injuries or health issues resulting from following fitness or nutrition advice
• Actions or content of third parties or other users
• Any unauthorized access to or use of our servers or data

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Account Termination

You may delete your account at any time through the Dashboard settings. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms within the app and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
